Hawke's Bay Times. Nullius addictus jurare in verba magistri. TUESDAY, APRIL 16, 1872.
We understand that the fore-and-aft schooner Three Brothers, for so long a time lying idle in our harbor, has changed hands, Mr. J. Johnson being the purchaser. It is, we believe, the intention of her new owner to have the Brothers forthwith placed in a seaworthy state. She was, this, forenoon, hauled up into what is known as " the preek " for examination.
The two, mails from Europe, &c, via San Francisco, which arrived at Auckland by the Nevada, reached Napier—ai least the Hawke's Bay .portion, of them —last night, per Keera, from the North. The same steamer conveyed this afternoon a supplementary putward English Mail, to Ix 3 forwarded by the steamer Welling! 0,11 from Wellington to. the. Manukaii.
In the Resident Magistrate's Court this morning the. adjourned case of syans y. Brown vas resumed. A witness, named Finnern,e was examined,, whose, evidence tended to, show that and riot Bro.wn, was liable, for defendant's wages, Decision reserved \\\l 2 p,m,, when judgment was given the amount claimed, and. costs.
We are informed that the steamer Rangatira is expected to leave Wellington for this part to-morrow. In the District Court this morning, in the estate of the late Mr T. Bell, letters of administration were granted to his widow. In Bankruptcy.— Re G. Hohbs, coach proprietor. Final hearing. Mr Lee, on behalf of the bankrupt, applied for discharge. Mr Stedman opposed the discharge. Mr Lee, in reply to Mr Stedman's objections, maintained that the petitioner had throughout acted in a perfectlystraightforward manner. The failure was caused by bankrupt's partner absconding with iUQO, ostensibly to purchase horses. The business could not resist so great a loss of capital, and after the disappearance of Thompson, a driver had to be employed and paid. With regard to the sale of the business to Mr Reynolds, to -vhich objection had been raised, this was the best that could have been done with it. Had not this been done, it would most likely have been sold at a great sacrifice to some person who would not use it, and only buy it to get rid of opposition. —Case adjourned for one month, to allow of the appearance of Mr Carlyon. A determined attempt at suicide was committed on the night of the 10th inst. at Pulleng's dining rooms, Auckland, by a man named Simpson, who had taken lodgings there only the same day. A noise was heard by the occupants of an adjoining room, who went in to know the cause, and found the man with his throat cut. A doctor was sent for, who, on arrival, attended and dressed the wound, and caused the man to be conveyed to tho hospital. The injuries were apparently inflicted with a razor, and are not considered to be of a serious nature. JSIq motive is assigned for such a rash act, but it is presumed that, having been drinking hard for some days, he had attempted self-destruction while under temporary delirium. Business is so slack in the Wellington jail that a reduction in the number of the warders is about to be effected. -Referring to this fact, the Auckland Evening Star says ; —" It is a pity they could not. be sent to Auckland lo lighten our overworked wardens' labors." At Auckland, on the 11th jn«t., Mr Joseph Augustus Tole was admitted as a barrister and solicitor of the Supreme Court of New Zealand. The Launceston and Deloraine Rail way, in Tasmania, a Government line, is running at a loss of £IOO a week. Referring to the trial of Cyrus Haley at Auckland for attempted murder, tfcc, the Southern Cross, of the 12th jn>:t., says ; —" A considerably greater amount of interest was evinced yesterday in the trial than on any former day, if the number of spectators be the guaging test. Early in the day a large number had assembled in the gallery and also in the body of the court, but as the afternoon advanced the number' largely increased In the afternoon the number of ladies present in the gallery was very conspicuous. A large amount of evidence was taken, and before the mid-day adjournment of the Court the prosecution had closed their oase. On the Court resuming, prisoner called witnesses. With sonic of those he called he was singularly unfortunate, especially with Mrs Russell, who was evidently suffering much from illness. Instead of giving exculpatory testimony for the prisoner, she related many startling features of the case which have not yet been before the public. His Honor commented upon, the fact, and informed Mr Brook field she should have been brought forward as a Crown witness. When she related in simple but graphic language that one shot fired into the bedroom after she left it cut through the pillow within a foot of her little child lying in bed, and that the second shot fired into the same room, almost instantly after the first one, must have passed close on the other side of her daughter as she was lifting the child out of the bed, a profound sensation was created in Court The greater number of the witnesses brought forward by the prisoner stated that, during the varying, periods they had known him, none of them had heard him speak maliciously of Mr Thomas Russell. The evidence on both sides was finished yesterday, and the
jury once more locked up. To-day the prisoner will address the jnry, to be followed hy remarks from Mr Brook - h'eld, when his Honor will sum up, and entrust the case to the jury for their verdict."
