In the Resident Magistrate's Court this morning his Worship gave his decision in the charge of malicious injury bo property, -brought by the police against Mr Fv. P. Giffard, of Waitangi He said that there were two questions a h i ss ,ie—first, whether a bond fide question of title was involved ; and secondly, whether, if this was the case, the matter was still within the jurisdiction of the Court. He decided that the defendant had acted in a bond fide manner, believing that he possessed a title. He therefore dismi*sed the case, as beyond his jurisdiction —Mr Lee, on behalf of Mr GiiFard, applied for costs, which his Worship declined to grant.
