The prosecutor deposed th.it In had kept the riiiv m question in the Mission pad dock at Meauee for about 18 months, and that he missed her on the 27th nit. Some short time after, from what he heard, he sought her and found her on the Barra.k hill IS he had then ?>een branded OF, r/'ocett's brand, and J}fjr inane aiid tail had been cutoff close.

He Look possession of her. In crossexamination by Mr Lee, witness stated that Foeett also had a iilly running in the Mission paddock. Tt waw about the same age as the one in question, but wav an inferior animal, and of a different color. Basil Mouchelet, the manager ot the mission station, corroborated the evidence of the prosecutor He produced a «i a non-hook, in which there was a record of both animals bring reeei\ edinto the paddock. Deinpsey's lilly was described in the book; FocettV was not. He complained of the course the prosecution had adopted, in charging three persons with this offence, and thus closing tne mouths of the only two witnesses who could give, evidence in J7ocett'< favor, lie also adverted to the unsatisfactory evidence of the manager of the station, who should have produced the origina l record. His Worship said tin-re was no prhid facie case against Willis or M'Oai'thy, and they were accordingly discharged. The Court then adjourned to 2 p.m., when the evidence for the defence was to be heard.
