Hawke's Bay Times. Nullius addictus jurare in verba magistri. WEDNESDAY, JUNE 21, 1871.

In the Resident Magistrate's Court this morning the second information laid by R Marshall against R G-. Hawes, referred to yesterday, was dismissed, with 25s costs. W. Baxter v. Towgood.—A claim of .£ls for freight. Defendant had refused to pay, on the grounds that nine or ten coils of rope, a portion of the cargo on which freight was charged, had been lost by the upsetting of plaintiff'« boat in the surf, and that the remaindei had been landed a mile trotn the spot agreed upon. He handed in a bill of ,£l6, being the value of the wire and other expenses, as a set-off. The magistrate, after hearing the evidence, decided that no carelessness had been shown, and that the loss of the goods was a pure accipent, for which ihe plaintiff could not held liable.—Judgment for plaintiff for amount claimed. Defendant applied for leave to appeal on a point of law. His Worship replied that he would consider the application, and give an answer this afternoon.

A Raglan correspondent of the Southern Cross, in the issue of the 16th hist.., says:— Major Mair, the new Resident Magistrate of the district, made his fmt visit here last week. A meeting of the friendly natives was held, at which he was present. The subjects discussed were the proposed " aukati"- closing of the Aotea and IVawhia road against the Hauhaus—and the new assessor for the Taenui tribe. Most of the speakers were in favor of closing the road. lam not in a position to say absolutely that the idea of this " aukati " originated with the Government, but the system is eaid to be part of Mr McLean's policy ; and a very good system it v*ill be if thoroughly carried out—the interested clamors of the trading classes to the contrary notwithstanding. The Taenui assessorship h not yet settled. A " kupapa " lad of my acquaintance informed me to day that he was going over to Kawhia to see his father (a Hauhau), perhaps for the last time before the fighting commenced. I inquired what h'ahtinsr, and he asked me with an air of surprise if there was no mention in the papers of an intention on the part of the Government to go to war. On niy replying in the negative, he said that the Hauhaus meant to tight themselves then, and that their first move would be to attack Alexandra by surprise. J don't believe the rascals will muster the courage necessary to do anything, but the conversation fhows that the Kingites have not yet left off talking abour extirpating the pakeha.
