Samuels, the ground of application being that excessive damages had been awarded. His Honor considered a new trial desirable al»o, as the evidence in the case had been so evenly balanced. Ordered that- defendant pay costs of suit, £9 9s 6d; plaintiff's costs of application, £1 Is; and expense of a new juiy, £3 4s ; the trial to take place on next sitting day inst. Patrick Hogan v. Alexander Mackay, a claim of £23 15s 7d.—On the application of Mr Stedman, -who appeared for plaintifl', this case was adjourned to the next sitting of the Court.

Resident Magistrate's Court.— This morning, Bernard Shevelin was brought up on a charge of lunacy. Mr Inspector Scully said he had known the man for eight or nine years. He had only recently come from Poverty Bay, and was lodging with a shoemaker named Cai-ey. On Friday he went to Watt Brothers' breweiy, and bought a cask of beer, for which he paid, after which ho went to Air Bishop'*, and bought 48 loaves of bread. He afterwards bought a quantity of tobacco and pipes, his purchases altogether amounting to the value of £8 or £9. He had them taken in a cart to the old rifle butts on the White road, and deposited there, after which he went home and got his dinner. After dinner he sharpened a large knife, and alarmed the other inmates of the house by flourishing it round his own head. The knife was taken from him, and he was turned out. Information was given to the police, who arrested him on. Saturday.— In reply to the magistrate, the accused said he had bought these things "to satisfy a noi-e in his eai." He had paid for them, and it was his own business what he did whh them. He sharpened the knife "to cut a sti-ing in his ear." He wished his knife and razor to be returned to him.—Remanded for medical examination.
