The District Court to-day was again occupied with the case Parnell v. Sanmels, a claim of .£2OO for breach of agreement. Farther evidence was adduced, of but slight importance, and the counsel on both sides addressed the jury. The principal points relied on for the defence were plaintiffs general negligence while in the employ of defendant, his having bonded hi* own good* in defendant's name without the consent of the latter, and having done business on his own account in the same line as defendant while in his employ. In summing up, his Honor said that these two last points, if proved, would justify the defendant in discharging the plaintiff; and that if the jury were convinced that the plaintiff had atted in the manner alleged, the defendant was entitled to a verdict. He also gave the jury certain general principles a* to the a>sessment of costs, if they found for the plaintiff.—After an hours absence, the jury returned a verdict for plaintiff foi the full amount claimed, less the amount he had received from defendant for his services (£4O), and the amount he had earned pince he left defendant's employment (k 10), making £l5O.- Mr Lee gave notice he would Jipply for a new
trial on the grounds that the amount of damages was excessive, and the verdict against the weight- of evidence. He was also prepared to show misconduct on the part of the jury themselves.--Judgment for plaintiff for Jdlso and £9 9s 6d costs—Several minor cases were to come before the Court when our reporter left.
