Resident Magistrate's Court.— This morning the application of Paora Torotoro for a new trial in the case Peacock v. Torotoro was hoard. Paora gave evidence to the same effect as on last Thursday—that the summons had never been served at all. Mr Maddock, on behalf of JVI r Peacock, opposed the application, and and to prove the service of the summon:;, called Constable Ra\enand Mr F. Sutton. The first witness deposed that on the 27th May he gave the summons inio the hand of the defendant, who said " All right." Mr Sutton deposed that Paora had, in his shop, mentioned that he had been summoned by Mr Peacock, and had on one occasion' said that he had come to town without his gig, as he believed there was a warrant out against him, and he feared it might be seized.—The magistrate deferred his judgment until half-past 4 p.m., in order to seek for precedents. A number of civil cases also came before the Court, but we are unable to. report them to-day.
