Resident Court.—! This moi ning John Cunningham, charged with being drunk and assaulting the police on Saturday, was. fined <£l. John Leyden was charged with deserting fh<m the Armed Constabulary Force. Sergt. Baker deposed that he knew defendant as belonging to the Constabulary, On Saturday Inspector Roberts telegraphed from Opepe that defendant was absent from his post, in consequence of which witness arrested him in Napier. Inspector David Scanuerr deposed that defendant was reported absent from his post on Monday last. In defence the defendant sayi tljat he was* entitled to }iis discharge on giving three months.' notice, and that he had givea the necessary notice three months' since. Inspector Scannerr said that defendant and several others had given such notice some tfuaa, ago, tout instructions had been received from head quarters they were not entitled to their discharge. Defendant was enlisted for three years, which time had not yet expired. Defeiulaut denied that he had fyeen enlisted for any specified time. His Worship said that some proof must be given that the defendant had heen enlisted (or a specified time, and he therefore adjourned the case, defendant becoming bail i» the sum of £SO, and finding \wo sureties in the sum of £%b each, to appear when called upon.
