RESIDENT MAGISTRATE’S COURT.
■ TUESDAY, JANUARY 7. [Before John Curling, Esq,, E.M.J UNLAWFULLY ON THE PREMISES. Thomas Flotd was charged with having been in the house of Thomas Collins, on the night of Thursday, 2nd January, for an unlawful purpose. Thomas Collins, sworn, deposed : I am the leader of a musical band, and reside in Gariyle-street, Napier. On Thursday I was playing at Father Reignier’s gathering at Meanee, and returned home at night. My wife and I wont to bed about 11 o’clock. Before I went to sleep she told me she; thought the bedroom door was opened ) but I did not get up. She awoke me at 2 a.m., telling me she was sure there was some one under the bed, as she bad heard their head strike the bedstead. I immediately struck a light and sprang out of bed, when 1 saw the prisoner on his hands and knees, crawling from underneath. He was quite sober, and said, “O, Tommy, don’t say anything about this; I must have come here in my sleep or words to that effect. I ordered him out; he tried to shake hands with me, but I would not let him. After this statement had been signed, prosecutor stated that he examined all the doors and found them locked, and that the prisoner could only have obtained access by means of a back window which had been left unfastened. The prisoner, after being cautioned in ■the usual manner, said that he was drunk, land had no recollection of the aflair. I He was committed to take his trial at Ithe next sitting of the District Court (on jthe 4th April); and Collins was bound over lis the sum of £SO to appear and prosecute
