S C II E D U L E S. No. 1. ME AN EE DISTRICT. Starting at the Meanee Bridge, on the north bank of the Tutaekuri river ; following up that river to the Hedoliffe catting ; thence along the base of the hills to the Ahuriii harbor, so as to include alt the fiat lands of the Meanee; thence along the water’s edge to the mouth of the Tutaekuri river ; up the north bank of the said river to the starting point. Mo. 2. SOUTH MEANEE DISTRICT, Starting at the mouth of the Totava Creek on tiio Vt airangt (the S.W. boundary of the South Meanee Block); following up the Tutara Creek to tiie rakowhai fence forming the S.W. boundary of the South Meanee Block • along that fence to the Tutaekuri Waimate; up that stream to the northern boundary of the South Meanee Block ; following that Loan* dary along the road until it strikes the Tutaekuri river; down that river to its junction with the road at Torr’s stockyard; down that road to where it strikes the bridge over the Waitangi Creek; aud up that creek to the starting point—the junction of the Waitangi and Totara Creeks. No. 3. HAVELOCK DISTRICT. Commencing at the Ngaruroro at tlieN.E. boundary of the Township of Have* lock ; following that boundary in a southerly direction to the south-east corner of Suburban Section II; thence along the southern boundary of Suburban Sections 11, 10, 9,8, 7,6, 5,4, 3, 2, 1, 23, 22 and 21, to the south western boundary of the said township, to the N.E. boundary of the Pukaliu Block, and thence along the N.E. boundary of that Block to the Ngaruroro river, and down that river to the starting point. No. 4. CLIVE DISTRICT. Including the Township of Clive, West Clive, and West Clive suburban land (the two latter forming the Hikutoto Block). No. 5. M Oil AKA DISTRICT. Starting from the mouth of the Molmka river, and following the sea-coast in a southerly direction to the south-western boundaries of Block 10; thence following along the southern boundaries of Blocks 16, 20. 18, 31, 27 fc 29, 21, to the Molmka river; down the said river to its mouth; forming the starting point. CATTLE TRESPASS. (AS PASSED BY THE PROVINCIAL COUXCIL.J Tills. A Dill for the belter prevention of the Cattle Trespass. Preamble. D‘C .it Ciliictcb' by the Superintendent of the Province of Hawke’s Bay with the advice and consent of the Provincial Council thereof ’as follows :—■ Short Title. I. The short title of this Act shall be “The Cuttle Trespass and Impounding Act, 18(37.” Repealing ccrlain Acts, 11. The following Acts so far as concerns the Province of Hawkes’ Bay aro hereby repealed ; (1.) An Act passed by the Provincial Council of the Province of Wellington Session Ilf. No. S, entitled “An Act to amend and consolidate the law relating to Cattle Trespass and Impounding”' (2.) “The Impounding Amendment Act passed by the Provincial Council of Hawke’s Bay Session VIII No 8. But nothing in this Act shall repeal any statutory provisions whatsoever not contained in the said Acts expressed to be hereby repealed ; nor shall anything in this Act be restrictive of any common law remedies for trespass or special damages. Interpretation of words, io. 111. The clauses and schedules of this Act shall be governed by the following Interpretations. (I.) The words “ great cattle” shall include the whole equine trenus,, asses, mules and the whole boviuo genus. The words “ small cattle” shall include the whole ovine genus the whole porcino genus and g< ats. The word “cattle” shall signify both great and small cattle. (2.) The word “landowner” shall include manager bailiff resident agent and beneficial occupier. (3.) The term “notice” shall mean written notice delivered personally to or at the residence or homestead of the person sought to be thereby affected. (4.) “ Nearest Pound ” shall mean nearest in point of access. Superintendent to appoint Pounds and Poundkcepers IV. It shall be lawful for the Superintendent from time to time by pro* clamation to appoint public Pounds and Poundkcepers at such p aces as ho may think fit: and at any time to annul such appointments and make others and from time to time to appoint the salaiies of the Poutullceepers vided that no salary shall bo in excess of the Poundkeeper’s fees. llow to act when owner not known. V. In case of cattle trespass where the ownership is unknown, the landowner may impound the cattle in the nearest Pound. Provided* that any Pound exists withiu 20 miles from the place of trespass. How to act when owner known. VI. In case of cattle trespass where the ownership is known, the landowner may either distrain the cattle on his own premises, giving them proper food and water ; or impound them in the nearest Pound, if any within 20 miles from the [dace of trespass ; Provided that if he distrain the same on his own premises, he shall forthwith give notice to the owner to release them on payment of damages and expenses ; subject, as to any disputed charges, to the decision of two Justices of the Peace, Provided always that if cattle so distrained shall not be released within three days alter such notice, they shall he transmitted to the nearest Pound. Damages payable by owners of cattle distrained or impounded. \TL The owner of cattle distrained or impounded under this Act shatf be liable to pay to the landowner the damages specified in Schedule A t together with such special damages costs and expenses as the landowner may claim; subject nevertheless as to such claims to an appeal to two [Justices of the Peace,
