If the person coming, or his Agent, accepts of a passage and refuses or neglects to avail thereof after notice has been given iu writing that the vessel is to sail, the party so doing shall bo liable to forfeit half ox the passage money. In the event of death on the voyage half only of the passage money shall be charged.
