DOG ALLEGEDLY SHOT
Labourer's Claim Against Farmer Before Mr J. Miller, S.M., in the Magistrate's Court at Napier to-day, Baugi Spooner, of Bay Yiew, a farm labourer, claimed from William Edward Thomson, a farmer, of Pakaratahi, Bay 'view, the sum of £30, the value of a dog allegedly shot by the defendant while it was chained up at the plaintiff 's house on August 16. Defendant alleged that, on August" 12, the plaiu-t-iff's dog worried and ehased sheep and goats belonging to him, that many of the sheep were ewes in lamb, and that great damage was done, eighteen ewes in lamb and ten goats being killed by the dog. , Tho defenee counter-claimed £36 (the value of tho ewes) and £5 (the value of the goats). Mr S. H. Morrison appeared for the plaintiff, and Mr John Mason for the defendant. Evidenee was given that, on the day on whieh the worryiug was supposed to have taken place, the plaintiff had left Mr S. Bennett's place at Eskdale, where he had been working and went to Bennett's place at Petane. The dog went with him and was with him at Petone on August 13 and 14, tied to a waggon. On August 15, the plaintiu: went to his home 'at Tangoio, and when he returned to work on August 16 ho left the dog at home chained up. While .it was there, it was alleged, the defendant came with two other men and shot it. Judgment was given for plaintiff for £17 10/-, with costs £8 9d-. Thomson was non-suited on the counter claim.
