DUNEDIN, Last Night. A oase of importance to employers was he.ard in the Magistrate's Conrt this morning, the Magistrate, Mr. J. R. Barthofomew, reserving his decision. The Inspector of Awards claimed a penaity against Smith and Smith, Ltd., stating that two men employed had been placed on xation work, which meant that they had a week off for which they were not paid. The department held that regular weqkly payments must be made until the men were dismissed. . . , Mr. Stephens, for the defendants, said that the case was one of great importance fa the whole industrial community, for it mSant that, when work fell off, employers could nqt place men on a rationedi scheme, in which case many hreaches must have been committer. In the present case, when work fell off, the men were divided into tbree batches and employed in that sequence. There was no complaint from tho men nor ill-feeling. Counsel claimed" that there was ho provision in' the award for continuous work beyond a weekly period and the award reobgnised suapension without dismissal.
