RETURNS NOT SENT IN

Nuhaka Dairy Co. and Secretary Charged FINES 1MP0SED Charges uuder the Companies Act against the Nuhaka Co-operative Dairy Company, Ltd., and the secretary, B. Intyre, were heard by Mr J. Miller, S.M._, in the Napier Magistrate 's Court this morning, iines being imposed in six cases. The deputy-registrar of companies at Napier, Mr R. F. Baird, described the case as one of the worst he h»d encountered. Mr H. B. Lnak pro'secuted, and Mr H. W. Dowiing appeared in defence. The company was charged: (1) With failbg to notify the change of address of the company; (2) and (3) failing to forward to the registrar copies of tlie annual retnrns of the company for 1936 and 1935. The same charges were preferred against the secretary. "The department look upon this case as an extremely bad one, as they have done all they could to have these returns furnished," said Mr Lusk. "1 ain informed that this morning the required returns were furnished," Roy Fellowes Baird, assistant registrar of companies at. Napier, Baid that a3 far back as January the company was informed that notice of the change of address of the'coinpany was required. It had not been returned until this inoriiing. To Mr Dowiing; The case is brought not' only as a warning, but for punishinent also. I think it is the most groes case I have encountered. We sent the notice, pencilled in, and all the secretary had to do was to type .over the pencil and sign the form, but he refused to do so. Mr Dowiing said that he had been instructed from Wairoa that the i'ailuro to furnisk returns had been due to au oversigkt. He pleaded not guilty to the charge against the secretary for not notifying the change, as the office had been changed about 15 years ago, and the prqsent secretary had been in office only five years. Although he had continued the breach, he had not originally committed it. The Magistrate contended that the case was one of deliberate and gross neglect for a long period. The case was onc of the first in the district. A fine of £2 was imposed in each case.
