Tho bearing of a claim for £258 I7s 7d brougbt by tbo G-oldberg Advertising Agoncy Limited against Edward Lewis Thwaites, solicitOr, following tbe failure of a straw .vote competition organised to take place tbroughout New Zealand just before, tbe last general election concluded abruptly in tbe Supreme Gofirt wben defendant admitted liability for the amount claimed. The plaintifE company claimed ;that at defendant 's request it furnisbed a design for an election straw vote competition and arranged for tho printing of 340,000 circulars for him. It was allegcd tbat pn November 4, 1935, de- • fendant gave an as&urance that bo bad tbe necessary cash in band, but tbat he did not bave it and bad obtained credit f-rom tbe company by fraud. Defendant replied that be bad actcJ not on bis own accouat but us the director or solicitor for Scanuoll Brokfexs Limited, and tbat plaintiff company knew tbis.
