AUCKLAND, Lasb Night, . Doubt as to the authority of the Court to impose terms of imprisonment as penalties in cases of unemployed men obtaining moneys froin State funds by meaiis of false declaratiohs was expressed in the Magistrate's Court at Otahuhu by Mr W. H. IMcKeau, S.M. "1 am no b going to impose penalties by means of imprisonment," said tlie Magistrate. "It may be argued tlmL thero are olFences under a speciat Act, for which the Legislature has declared that persons resxionsiblo shall be liablo to lines. "I am uob sajing that it is wrong to take action in tho Court under tlie Justices of the Peace Act, but it may be possible for sonieono to apply for a. Habeas Corpus lvrit, and the Supremo Court may hold that iicnaltics through imprisonment by tlns Court ivere wrong. This Court is not going to do that."
