■ r« nnn, ^ Test Case To Be Conducted Tliat a test case should be taken to recover rates oel a proper.ty on wliitiU tlio rates havo not been paid, aud on which tho Grown holds a rnort^agoj waa the decision of the Hastings Borough Council last evening after considering the case in coniuiittee. It was pointed out that as the resulfc of a recent decision, the council has power to obtain judgment for outatanding ratea, , on properties mortgaged to the Orown, and, in tho event of tbe judgment not being aettled, to proeeed to sell the property subject to tho Orown mortgage, provided the consent of the Crown to thcso proceedings was obtained. It was decided to conduct a test case in a partieular case in which five years rates were owing, and for which a judgment had already been obtained. and that the necessary steps to obtain the consent of the Crov"n to the sale of this property shouid be taken.
