£1500 DAMAGES CLAIMED
Farmers' Action Against Napier Motorist A Tutira farmer, Launcelot Goodenough Riee, is claiming from a Napier motorist, Thomas Agnew, the sum of £1500 in an action for damages before Sir John Reed in the Supreme Court at Napier to-day. Several witnesses are to be called in the action, which, it is expected, w-ill occupy the greater part of the day. Mr C. W. Nash appeared for the plaintiff, and Mr H. B. Lusk for the defendant. The following jury was empanelled: — Messrs W. F. Collins (foreman), P. Green, H. S. Crawley, I. N. Smith, A. Hariison, J. D. Thompson, D. B. Haines, P. J. Kenwa, W. J. Lowe, B. H. Bickertou, G. Bull, W. Forrest. Plaintiff was riding a motor-cycle from Tutira to Napier on the day of the accident, and at tlie intersection of George 's Drive, Carlyle street, Thackeray street and Hyderabad road was travelling at a slow' speed when he met tlie defendant's car and swerved to the riglit, said the statcmenl of claiin. The otlier car, which had -previously given rigkt of way, served into him. - ■ The defendant, it was claiined, was uegligent in that he did not give way or stop, did not have the car under proper control, and did not steer elear. There, was no suggestion of speed in the niatter, but plaintiff had. suff'ered a pcrnuinont injury to the ]'c.ft foot, disabling him to a large extent and forcing him to clnploy lal>our for work which he had previously been able to do himseif. * The 'sum of £19 8/6 had been agveed upon as special damages a's far as medieal expenses were conc.orned. The case was still in progress when the Herald-Tribuno went to press this afternoon. 1
