STOLE BOTTLE OF WHISKY

Oitence After Party at Hotel MAN ADMITTED TO PROBATION The theft of a bottle of whisky from the Meeanee Hotel following a pai'ty there led to the appearance before Mr J. Miller, S.M., in the Napier Magistrate 'b> Court this iliorning of Frank David Bennie, a truek driver, who was admitted to probation for one year. Be. was ordered to take out a prohibitiott order. Detective K. W. Mills said that defendant had been to a party at the Meeanee Hotel and on the way out took a bottle of whisky, whieh was consumed in a car on the way home. At the time of the offence he had had a previous conviction, and he was actually on probation at the timo for the theft of two overcoats. Mr H. C. SproUle, for the defendant. pleaded that the offence was in fche nature of a f oolish prank, and that no effort had been made at concealment. Tle asked, in view of the fact that the defendant was afraad of losing his job, that the name be suppressed. • The Bench; I have no power to inake an order for a second offence. The Magistrate commented that t it was most unusual to grant probation for a second offence, but in view Of the fact that the offence did not seem to be a premeditated one the term of the probation would be extended for one year on condition that the value of the whisky was refunde.d and that a'prohibition order was taken out for the period.
