Charges Against Restaurant Keeper PAYMENT OF WAITRESSES Convictions on five charges of breaeh of the Shope and Offices Amendment Aet were entered against Andrew Paxie, restaurant-keeper, by Mr J. Miller, S.M., . in the Napier Magistrate's Court this morning. Tho charges, brought by the Inspector of Awards, Mr E. A. Wood, were beard last week, and adjourned to ennble the Court to arrive at an assessment of tho overtime due. Mr John Mason appeared in defencc. Defendant was charged: (1) That ko employed a waitress. Ivy Seastrand, and failed to . pay her the minimum wages prescribed by the award; (2) that on April 2, 1987, being the oecupier of a shop within the meaning of thc Shops and Oifices Aet, lie failed to keep a wages and time hook in the prescribed form; (3) that, being the occupier of a shop within the meaning of the Shops and Offices Act, ho did, during a period of 24 consecutive hours in each week, employ Miss Gilda Lupi for extended hours and fail to pay overtime for such hours at the rate of time and a-half; (4) that he failed to give written notice to the inspector within 24 hours of the extended time worked by Miss Gilda Lupi; (5) that he failed to notify 'the inspector within 24 hours of extended time worked by Miss lvy Seastrand. The inspector claimed also penalties of £10 for each case of failure to pay overtime. On the charge of failing to keep a wages and time book in thc prescribed form, a fine of £2, with 10/- costs, was imposed; on the charges of failing co pay overtime to Miss Lusjn, defendant was convicted and discharged; and also on the okarae of failing to notify tlie inspector of overtime worked hy tho saiue empioyee he was convii.'ted and discharged. The same procedure was followed in regard to similar charges in respect of Miss Seastrand when an offer was made to pay £5 as the arreare. In the two civil cases, judgment was gdven to the plaintiff, and a penalty of 2/- in each case was imposed. An offer of a sum for the second waitress i3 to be referred to her for acceptance.
