AUCKLAND, Last Night. The trial concluded in the Supreme Court late to-night of Dorothy Bakcr, married, aged 33, on charges of counselling or procuring Eaymond Grigg unlawfully to use an instrument on a girl aged 19 at Panmure on September 1, and on another girl on August 25. The Crown Prosecutor (Mr. Mere-, idith) said accused was charged with ;having procured the commission of these offences, one on her own daughter, SLged : jl4, and the other on a girl aged 19. It iwas not suggested that accused herself did act, but that she had counselled a man named Grigg to do so, If that were ■o, she would be equally guilty with the man. Grigg was not charged, because he could not now be f ound by the police. Summing np, Mr. Justice Fair said' that, as far as the evidence on tho count involving accused 's daughter was concernedj it had failed to provp that "an instrument or other similar meanS ' ' was used upon her. The girl had said she could not remember, and as that went to the essence of the charge, he directed that, on that count, accused must be found not guilty. There was evidence of several witnesses to support the other charge, and accused had substantially admitted that she had made certain arrangements and had looked iafter the girl after the operation. After a retirement of four houre, the jjury returaefl to report that they had ;not agreed, and they did not think there iwas any possibility of their doing so. They were accordingly discharged. Mr. Meredith's application for a new I trial during the current session was igranted, and an application for bail for ;accused was refused.
