BANKRUPT FIRM CHARGED
Alleged Failure to Keep Books HEARING ADJOURNED Charges of two breaches of the Bankruptcy Act were preferred against a firm of Napier caterers consisting of William Jaines Hyde, Laurence Frederick Mooney and Phillips McCabe before Mr J. Miller, S.M., in the Napier Magistrate' s Court this morning. Owing to a difficulty in arranging counsel for one of the defendants, the hearing was adjourned until August 12. Detective K. W. Mills appeared for the poiice, Mr C. W. Nash for Hyde, and Mr J. M. Runciman for Mooney and McCabe. * The charges were:— (1) That, having been adjudged bankrupt on November 2, 1936, they did on July 31 and on divers dates between July 31 and "October 19 contract debts and at the time of contracting such debts could not have had any reasonable or probable expectation of being able to pay them as well as their Other debtp. (2) That, having been adjudged bankrupt on November 2, 1936, they had> withiii the space of three* years before the commencement of bankruptdy, failed to keep such books of accounts as were usual and proper in the business carried on ,by them and as suffieiently setting forth their business transactions and disclosing their financiai position Mr Nash explained that a difficult position had been reaclied in that the dei'endant Hyde had come to Napier this morning assuming that Mr Nash could conduet his deience. Mr Nash said that for various reasons he was unable to do tliis, and it had been arranged that Mr W. Selwyn Averill should defend Hyde. Owing to jbhe short notice Mr Averill could not be present at the Court, .and asked for an adjournment.
