Unusual Action in Napier Court

A ylaim for the return of ehattels to the value of £7 3/6 inadvertently left with the wrong caterer was made by Joseph Henry - Edmundson against James Weathered in the Napier Magistrate 's Court this morning before Mr J. Miller. S.M. At the conclusion of a brief hearing judgment was given with costs in favour of the plaintiffi. Mr H. B. Lusk appearcd for the plaintilf, aitd Mr S'. H." Morrison for the defendant. It was explained by Mr I.usk t.hat Mr Edmundson, tho bailio in the matter, had hired from a caterer, Mr Murdoch, a quantity of knives, forks,- and spoons for a party in liis p)iivatc home. When he went to Napier to return them, they were 'inadvertently left with the 3efendant in another street, ahd' part, prodaced in Court, had been reta'ined. The plaintiffi was responsible for the goods. and a claim had been made upon him for them. John Hardy Murdoeh -was crossoxamined by Mr Morrison as to whether the cutlery had been purehased from him by the company -of Weathered and Murdoeh. ITe produced receipts for the purehase of theTproperty/and the Bench entered .iudgment for the plaintiffi. making.au order for the return of the articles.
