WELLINGTON, Last Night. Judgment was delivered by the Chiet Justice, Sir Michael Myers, and Justices Ostler and Fair in the ease Gower and Gower versus Cornford and Gillies in the Court of Appeai this morning. The appeai was from a judgment of Jlr Justice Smitb , in November, 1935, when it Avas held that appellants, as administrators, in the estate of Benjamin Gower, deceased were liable to pay £3400 with interest in respect of a second mortgage originally given by Benjamin Gower to Percy Alexander Gillies } since deceased, of whose estate the respondents are the executors. The judgment holds that respondents are entitled to hold the judgment in their favour by the Supreme Court. The appeai was dismissed with costs on the highest scale as in a case irom a distance.
