The Supreme Court, in giving judgtuent in the case of Signora Emilia Riva who was married dn 1921 upheld the finding of tke Papal Ecclesiastical Court that an agreement made prior to the marriage to avoid the procreation of children invalidated the marriage. Litigation has been proceeding for five years. It began dn ■ Pelting where the Ecclesiastical Court declared that .matrimonial accord is an act wh8reby both parties give and accept the eternal right for the procreation of children, Any pact contrary thereto which ie signed before marriage is contrary to the scope of the act.
