WELLINGTON, This Day, When the third day of the Appeal Court hearing of the dispute in connes* ■ tion with the Clerical Workers' Union opened this morning Mr, O'Leary continued the discussion on the cnxcial question of whether the registrar of indus.trial unions had been justified in registering the defendant union, Gouusel said that thia depended qn the d«finition of the word "industry" in th« Act. The occupation of a clerk was littingly deseribed by saying that he was employed in the calling or employment of a clerk, just as a driver worlring for a butcher, carrier or baker would have hia occupation correctly deScribed as being employed in the caUing or employment of a driver. Part of ths seetion of the Act containing ths words "any business, trade or manufacturing undertaking," contended Mr. O'Leary, might be regarded as specially applicable to industry from the einployers' point of view— that is, they describe a particular branc o f the industry in which an employer uses tho labour of others.
