Unusual Case in Waipukurau

WAIPUKURAU, Last Night. An unusual case was heard in the Waipukurau Court to-day when ABlom eought an order ±or possession of a house in "Gainsford Terrace owned by him, but which had been rented by H. Eden, who had vacated the house about five months ago, leaviug a family called Brown in possession. It appears that Eden allowed the Brown family to share the house with hjm when be waa renting it, but that subsequently he left the house but did not take the Brown family with Mm. 3). W. Jfeild gave evidence as to the steps he had taken on behalf of Blom to regjain possession of the house. Brown, in evidence, said that Blom had told him he could stay in the house until he could find another, provided he paid the rent on behalf of Eden. Blom claimed that he had consistently refused to accept Brown as a tenant, and that all rent paid to him had been reoeived on behalf of Eden. The Magistrate held that Eden was the tenant and that as he had vacated the house and obtained another the onus was on him to give the owner vacant possession of the property. An order was made for possession in three weeks.
