Solicitor's Claim Against Pubiishers VERDICT FOR DEFENDANT

WELLINGTON, This Day. "I am not satisfied that any false representations have been proved," said Mr Justice Eeed in the Supreme Court, yesterday, in giving judgmexxt for defendant in the civii action brought by John Burna Crichton, solicitor, Palmerston Nprth, against Butter worth and Co.- (Australia), Ltd., law and medical pubiishers. The case arogie from the sale of a complete set of the seeond edition of Halsbury's "Laws of England." Plaintifl alleged that the volumes supplied to him were not new, and he sought to reeover £57 3/-, an amount paid by him toward the cost of the books, together with £20 damages for alleged breach of warranty. The defence denied that defendant's salesman had induoed plaintiff to make any of the contracts. It also denied making each and every one of the alleged misrepresentations, and making a fraudulent istatement. While defendant company admitted that plaintiff had demanded a refund of tbe money paid by him, it denied his rigbt to do so. It was set out that %ny presentations made by or on behalf of defendant were true in substance and in fact. Finally, alleged concntipn and alleged warranty were denied. After hearing evidence for botb sides, his Honour said he was not satjsfied that there was anything in the nature of misrepresentation. "You are trying to succeed on a purely technical question," he remarked to counaeL Judgment was entered for defendant with costs and witnesses' expenses.
