AUCKLAND, Last Night. A fine of £15 was imposed and his driving license cancelled when a farmer and piOk vendor, Bertram Edmund Bezar, aged 30, appeared before Mr U. S. Orr Walker, S.M. in the Police Court, denying the ehaTge of being intoxicated in charge of a motor van in Queen street on Eebruary 23. Summarising the evidence the Magistrate said' it showed that defendant had consumed thfee bottles of beer on the aftemoon oi' his arrest. Yet while it was beyond fact that his broath smelled of liquor he gave no othor signs of intoxication ' when exainined by two Idoctors some timb later. Allowance had "to be made for possible tendeney of the police after. being informed that an intoxicated driver had bumped into anothqr car, and, the possible wrong tendency of a doctor supporting his own patient. "I have formed'the opinion that acpufecd was unquestionably intoxicated at the timp of his arrest," the Magistrate continued." It is not for me to say how much ho was intoxicated at that material time, for it is possible his .condition had improved by tho time he was medically examined.'' In imposing a fine oi £15 aud costs and cancelling accused;s driving license f'Or h period of nine months, the Magistrate said, in reply to counsel's appeal for the retention of the licence, that the forfeiture of tho licence had to be regarded as part of the penalty in such case*.
