Charge That Name Was Added Surreptitiously JUDGE'S DECISION

WELLINGTON, Last JNight. A charge that - the name of the Hawke's Bay Buiiders, Contractors and General Labourers' Union had been added surreptitiously by the Conciliation Commissioner to an award, was made before the Arbitration Court in chambers to-day, in the dispute between the New Zealand Federation of Local Bodies, Buiiders and General Labourer3 and the Wellington Buiiders, Contractors and General Labourers' tJnion on the one hand and the Hawke's Bay Union on the other. The Hawke 's Bay Union claimed that ! its name had been added in a proper way and made counter charges of misrepresentation. After considering the case, his Honour said that at the request of the parties, the award was put through by the Court at the session just before Christmas, for the convenience of the parties and to assist them. In the norma! courae the award could not have come ^forward until next ses3ion in Wellington. Both employers and workers were represented and asked that the recommendations of the commissioner should be made into an award. It was the duty of those parties to check up every portion of the award and the parties had tliemseives to blame if they failed to do that. The Court was asked to make an award and duly made an award and the Judge signed it. That, therefore, must be the award and was the award of the Court. His Honour said that the signed copy of the award was not altered. If one Of the parties considered that a mistake which was remediable had been made in including that union, it could make application to the Court and have evidence brought. In the meantime the award must staud.
