VERDICT OF GUILTY
Charge Against McBirney A plea of not guilty was entered in the Supreme Court at Napier before Mr Justice Ostler this morning by David William McBirney, a labourer, of Napier, to a chargie of obscene exposure before two girls, aged 12 and 14, on November 19 last. The jury retired at 11.45 to consider its verdict and had not returned when the Herald-Tri-bune went to press this afternoon. The Crown Prosecutor, Mr R. B. 1 Lusk, conducted the case for the police. McBirney, who pleaded not guilty, was represented by Mr A. H. D. Mayne. The following jury was empauelled: — Messrs A. H. Burr (foreinan), A. H. Fisher, G. A. Bartlett, O. E. Wrighton. J. Archer, J. A. Hannah. A Deverell, J. G. Ewen, J. Walsli, T. J. Exeter. S. G . Thornton and E . A . Bonifaco The defence to the charge was that McBirney had not exposed himself wilfully before the two giiis and that, no sooner had they observed what he was doing than they turned and walked away. After a retireinent of three and ahalf hours a verdict of guilty was returned.
