Charge of Theft Against P. R. Smyrk An indication that the Grand Jury were^ finding difficulty in Teaching una,nimity in the matter of finding a trui hill against Perey Eaehurn Smyrk, "who is charged with theft of moneys in his capacity as secretary of the Waipawa Hospital Board, was given to Mr Justice Ostler this morning by the foreman, Mr L. Piekering. After being in retirement for over an hour, Mr Piekering informed His Honour that the Grand Jury were divided in their opinion as to whether a true bill should be returned. "We want to know if, in bringing in a no bill, it is neces'sary for us to hear th# evidence of the whole of the wit' oesses," he said. His Honour: There are 23 of you gentiemen on the Grand Jury, you 'II notice; therefore there must he * majority one way or the other. If the majority say that a no bill should be returned, that means that you must so act, but you must hear the Crown evidence first.
