CLAIM FOR £75 FAILS
DEATH OP AIREDALE. (By Telegraph—Press Association.) WELLINGTON, June 16. Judgment, for defendant was given by Mr E. Page, S.M., in the Magistrate’s Court to-day in an action for £75 v damages brought by Captain F. C. Graham, Petone, against Timothy C. Leadbetter, horse trainer and owner, Petone, Allegations were made byGraham that a stable boy in the employ of Leadbetter had thrown, a stone at an Airedale bitch_ “Meg Merrilees,” and injured her, causing premature whelping, the death of live of her litter shortly after birth and. the subsequent death of the bitch. The magistrate con sidered that,. assuming it was established that the bitch had been struck by the stone, the weight of evidence and the probabilities were that her subsequent death was due not to that, but to lack of proper attention during and subsequent to her whelping. Plaintiff had not shown that any act of defendant’s servants caused or contributed to the bitch’s death or to loss of the pups, and the claim must therefore fail. .
