BANKRUPT CATTLE DEALER.
DECLARATION ON OATH. Although at the meeting of creditors called on i'riday there was not a' quorum of creditors, the statement on oath was taken of; Frederick Jewell, whose liabilities were shown at a total of £llO 17s 5d: —Normanby Town Board £54 10s sd; Roy Nicholson Bennett (.New Plymouth) £4 16s 6d y Taranaki Daily ISews £sl 10s 6d, and whose only assets were £35 10s. —one cow £5; rent paid in advance' under Native Leases, taken back by the owners, £3O 10s.
Besides the D.O.A. (Mr. R. S. Sage), there were present Mr. G. J. Bayley and Mr. Don Stewart, representing the Board. Mr. A. E. Gorton appeared on behalf of the bankrupt.. Bankrupt in a sworn verbal statement said in answer to the D.O.A. that he was forced , to iile because he was threatened with gaol. The amount due to the .Town • Board was for rates on native land held by him until four years ago, and arrears. He was put •out of the lease just before the slump. To Mr. Bayley : He paid £6O per annum until 6 months before giving it lip, when it was raised to £IOO. The action, had been pending for eighteen months because lie had promised to payand therefore the summons was held oft: He was a dealer by trade and had been in difficulties for three years. He had a wife and two children to keep, and was separated under a- private deed. He had paid his wife £3 a week ago. He had a section of 14 acres which-he was allowed to graze in return for keeping down noxious weeds. He bought and sold cattle, and was financed by Mr. Powell. He had at one time borrowed £lO5 from Powell, and was to pay 12 per l cent, interest. He had kept no books since he had given’ up the butchery business four years ago. Powell and he shared profits on dealing. He admitted having bought and sold a good few cattle, which were sold in his name.
Mr; Bayley: He has been doing a lot of dealing. I suggest his statement with Mr. Powell would prove interesting.
In reply, bankrupt said he had some fat cows, about thirteen, for which £55 had been received, of which' he thought Powell got £lB on one occasion and £l2 on another, on account of money lent. The cattle bought were his, and he had to pay interest on amounts borrowed. He had had no dealings with Powell since August. He had six or eight cattle when he went out of the leasehold land.
In reply to a further question bankrupt said he had done no betting lately and had not been on a racecourse for three years, nor put a pound on a horse during that period? He said he had two horses on a section at Normanby but they had been sold to Mr. tooq’ t? ad P a * d him £2O in August, iysio. He was allowed to have possession of them, and used them for the droving, which he had taken up lately lo the D.O.A. he said he had offered to. pay £1 per week. The D.O.A. said this statement would have to be produced, and he warned Powell that if it were not forthcoming he would be summoned to be examined on oath.
In reply to Mr.. The examination then concluded.
