CHARGE OF RECEIVING.
SEQUEL TO THEFTS. (by TELEGRAPH-PRESS ASSOCIATION. - AUCKLAND, Nov. 12. At the Supreme Court to-day, Walter McCarthy pleaded not guilty to the theft arid* receiving of stolen goods and wilfully attempting to defeat the course of justice arising from the theft of electrical material from Turnbull and Jones’ warehouse, for which another. man has already been convicted. During the hearing the allegations of theft were withdrawn. Counsel for the defence said, in reference to the charge of obstructing, that it- would be a grave hardship if every accused person who did not tell the truth immediately to the police should be guilty of a separate crime regarding receiving. Counsel said people in motors took the stolen goods to the neighbourhood of the two electrical shops, and the Crown had not established that the accused received anything. As regards the other articles, accused did not know they were stolen.
After four hours’ retirement the jury returned a verdict of not guilty of attempting to defeat the ends of justice, hut failed to agree on the receiving charge. A new trial will take place on Monday.
