Reserved judgment was delivered by Mr Justice Reed in a case wherein James Taylor, farmer, Makino, sued the Cheltenham Co-operative Dairy Co., Ltd., for £Bl 2s lid for cream supplied* during January, February, and March, 1924. The defendant, company counter-claimed for £173 2s lOd, moneys allegedly overpaid during March 1, 1923, and February 15, 1924. The defendant .company did not dispute the claim, but based the counter-claim on the allegation that the plaintiff and Simpson, an employee of the company, conspired to take unfair and inaccurate samples of plaintiff’s cream. . His Honour commented on the case of another supplier. Simpson'was detected taking unfair samples, dismissed from the company’s service, prosecuted, cqnvicted and sentenced to six month’s imprisonment. He ruled that it had been proved that Simpsou had taken unfair samples. This was a case of which the plaintiff must have- been cognisant. Judgment was given for defendant company for the amount of the coun-ter-claim, less the,amount of plaintiff’s claim, which was admitted. The defendant company was given . the costs of tlie action.
