Hastings S.M. Court.

CIVIL"BITTING. (Before B. Turnbull, S.M.) At the S.M. Court this morning the following cases were disposed of": NY. A. Carter v. P. Diamond, £ 1 6s Gd. Claim allowed, costs 9s. S. liidgway v. Inia, £2 12s 6d. Claim allowed, costs 13s Gd. S. Ridgway v. Henare Tupurupura, f 1 17s. By consent, costs 17s (id. J. Tyerman v. Diamond, balance of account 9s. Judgment for amount claimed with 8s costs. On the Court resuming at 2 o'clock, Stubbs, Patterson and Co. v. Pene te Tae. This was a case for the recovery of £l4 19s 9d, the amount of a promissory note given by defendant in liquidation of two debts, one due to Mr Lawton and the other to Messrs Thompson Bros., butchers, for both of whom the plaintiffs acted as collectors. Mr Lewis appeared for the plaintiffs, and Mr Scannell for the defence. Mr Scannell submitted that- the order

of the Court made at the last sitting din cling the plaintiffs to supply him with particulars of the accounts had not been complied with. Mr Lewis -aid his clients supplied all the particnlr rs possible. Mr Thompsons' books had ! een burnt about three years ago, so it was impossible to "furnish the items of that account, but Pene te Tae tacit!y admitted his liability in signing the promissory note. He asked permission to call Mr Thompsons' evidence. Mr Scannell objected to the case being gone into until the order of the court had been observed, and Sir Turnbull concurred in this view of the case deciding in favor of defendant with £2 8s costs.
