The Kirby-Herman Dispute.
At the S.M. Court this morning, before Mr A. Turnbull, the adjourned case of J. 11. Kirbv v. P. A. Herman came on for hearing. This was a claim for £65, less commission, the balance of a cheque given by plaintiff for purchase of the printing plant of Mr. A. A. George. Mr Lee appeared for plaintiff and Mr Scannell for defendant.
Mr Ivirby, being sworn, was crossexamined at length by Mr Scannell as to his negotiations with Mr Herman and Mr George. Mr A. A. George, sworn, gave a lengthly statement of the particulars of the proposed purchase of his plant for the sum of £SOO. He bad printed canvassing forms for plaintiff, who told him to condsider the transaction complete and perfectly satisfactory. Witness was cross-examined by Mr Lee as to the receipt of £l3 ss. from Herman and as to why he gave a promissory note for the amount if he considered it part of the purchase money.
P. A. Herman, sworn, entered fully into the details of the dealings with plaintiff. He had been instructed to purchase George's plant and had concluded negotiations for same. G. Vickers, sworn, corrobrated the evidence of interview between plaintiff and last witness. At one o'clock the Court was adjourned until Friday.
