Howe Appeal Case Decided finally and Negatively
P.A. WELLINGTON, June 3. The hearing of the appeal of J. H. Marshall, Titahi Bay, to the New Zealand Racing Conference against the decision of the Auckland District Committee, which confirmed the t.<--tion of the, Judicial Committee oi the Auckland Racing Club in relegating Howe to third place in the 1947 Auckland Cup, and in placing Balgowan first, and King’s Ransom second, was completed in Wellington tonight. The judges dismissed the appeal. In the couse of a lengthy judgement, they found that Howe did interfere with the chances of Balgowan by boring towards the outside of the course in the straight, and carrying Balgowan with him, and from then on, seriously hampered him and bumped him and restricted the riding efforts of his jockey. At the same time, there had been some lesser interference with King’s Ransom, but his rider was not so restricted. The judges ordered that Marshall’s appeal deposit of £2O be forfeited. It .was further found that H. V. Lunken, owner of King’s Ransom, who also appealed on the grounds that his horse had been interfered with to a far greater extent than Balgowan, had not complied with the requirements of the Rules of Racing, in formulating his appeal, which was, therefore, rejected. The appeal judges were Messrs J. McFarlane, Laing (Masterton) chairman; P. A. O’Neill (Wanganui); and J. Graham (Fielding).
