A lump sum of £llO 2s. 4d has been awarded by Mr Justice O’Regan in a deferred judgment on a claim by J. Fairman, a miner, of Dobson, against Grey Valley Collieries, Ltd. (now in liquidation) which was heard in the Compensation Court at Greymouth on April 16. In giving his decision, His Honour said: “In the present case the plaintiff was a man inured to hard labour and not .fitted foxclerical work. Were he a clerical worker, his injuries could , not .affect his earning capacity, and so there could be no further claim to compensation. Undex- the circumstances. I have decided to allow him a lump sum in that it seems desirable that the liquidator of the defendant company should be relieved of the obligation to make provision for an indefinite liability, and it seems not less undesirable to oblige the plaintiff to rely on his rights under Section 47 of the Act.”
