The Board admitted that the tn* gine turned the corner on the wrong side .but claimed that under the Fire Board's Act it had power to send an engine to a fire at all possible speed ana! therefore was not liable.. The Board also claimed that it was: not liable because the Brigade Superintendent was a statutory officer [with duties defined by law. Messrs Hugo, Inspector of Brigades, Erck,' Superintendent of Uhristchurch Brigade, and Smith, exSuperintendent, .gave evidence of the universal practice of brigades to ignore "the rules of the road when proceeding to a fire .
