WARDEN'S COURT, AHAURA.

Friday, February 13. (Before Mr Warden Whitefoord.) John Thomas applied for permission to make a tail-race at Baxter's Creek, River View, near Ahaura. The application was opposed by John Baxter and party, on the ground that; the proposed race would run through their registered head dam. The application, was refused. The following applications were granted, there being no opposition : — John Potts, Ligoon Terrace, Nelson Creek, for 30 x 150 yards, for a dam site. James Lock, on behalf of the Orwell Creek Gold-mining Company, for 10 x 100 yards, for a reservoir. Knight and Vevis, for 100 x 300f fc a^ Wyndham Creek, Orwell Creek, for efc* dam. . Martin Maloney, for 85 x 170 ft of auriferous ground at the Red Hill, between Topsy Crfeek and Napoleon Hill. Mathias Willing and party, for a double area claim in a creek running next and parallel to Brown's Lead, Noble's. Cass and Bryan, for a frontage tunneling claim at Brown's Terrace. Martin Maloney, for a tail-race at Red Bill. John Roberts, for registration of a tunnel at Owen's Look-ont. John Baxter and party, for protection for their claim, race, and dam at River View for sixj months, during race extension, j Fitzgerald and Hennessy, for registration for a head-race, to cost L6OO, at the Blackwater, Little Grey. E. L. Thompson, for registration for a head and tail-race, to cost LIOB, at tho Snowy River, Little Grey. Bryson and Cass, for registration for a tail-race, to iost L4O, at Brown's Lead, Noble's. Frolli and party for registration for a head-race at: Mosquito, to cost LI OO. Kerr andjparty for head and tail-races at Try-Agam Terrace, Nelson Creek, to cost L3O and 1.200 respectfully. Larkin v. Dexter. — This case was ad- ' • 1 journed from the last Court for the surveyor's report. The complainant charged the defendant with illegally interfering with the works in connection with a beadrace the plaintiff is taking from Callaghan Creek, Ahaura, to Try-Again, Nelson Creek. Mr Lewis submitted his report, and the Warden, in making an order, adopted the suggestion that 11 chains of fluming would be necessary at the place where the race was endangered." An order was made that the precaution pointed but in the surveyor's report should be complied with. An application by the Orwell Creek Gold-mining Company to be placed in possession of the head-race formerly known as the Noonan and party's, at Orwell Creek, waa not proceeded with,

Wood and Brown for permission to make a tail-race t to cost L3O, at Moonlight Creek. — Granted. Bernard Magee applied to the Court with reference to the new survey of the township at Hatter's Terrace, Nelson Creek. The applicant said he was erecting a building there, and a complaint was made to the surveyor by Messrs Kennedy and Hunter, owners of the premises adjoining the applicant, that his building would encroach on their land, or the approach to it. Mr Lewis produced a sketch plan of the locality, from which it appeared that owing to the irregular manner in which the business people at Hatter's had originally marked off and built on their sestions it was now almost impossible to follow any definite plan in laying out the new streets. The buildings of Magee and Hunter and Kennedy were situated in the main "jumble" of the town, and from the position of the sections on which they stood, if the building were extended backwards the full width of the frontage they would run into each other, and thus close a right-of-way long in public use. An order was made that the parties should alter the plan of their building so as to leave a xight-of-way of five feet between them at all times for the public convenience. A complaint of Frederick Gosling that, if Magee built his house as he intended, he would wall up his (Gosling's) premises in such a manner that he would have no means of escape in case of fire. After hearing Mr Lewis, the Warden decided that Magee could build on the side adjoining Gosling, as it was shown that he (Magee) was in legal occupation of the space he claimed. Bernard Magee, then applied with respect to his tenure of the wire footbridge across Nelson Creek at Hatter's Township. The applicant built the bridge, and has for several years kept it in repair under some arrangement about licenses, and the Government is now negotiating for possession of it. The terms of the bargain did not transpire, but the Warden requested Mr Surveyor Lewis, as a preliminary step to make a valuation of the structure and report to the Court. John Hay ward for a lease of 25 acres of land as an agricultural area at Nelson Creek. There was not any opposition to the application. Mr Surveyor Lewis reported that the land applied for was on Potta's Flat, on the track between the Deep Lead on Lagoon Terrace, and TryAgain. Portions of the area were three chains, and other portions one and a half chains from the foot of the terrace in which the Deep Lead is situated, but

there was ample room for any tailings or other debris which might come down from the lead. The Warden said if it had been shown him that the granting the area applied for would in any way interfere with the working of the lead, he would not recommend it. Mr Lewis would alter the boundaries, and if necessary reduce the area, so as to leave ample space for the deposition of headings and tailings from the lead, and subject to this reduction the application would be recommended. The Court adjourned to the 20th of February.
