H. • Revell, Esq., Charles Somniej s was charged, on the information of the Collector of Customs, with a breach of the Customs Act, by passing a prime entry on goods of a value greater than declared. Mr Perkins appeared to prosecute, and Mr Warner for the defence. The facts were that defendant passed an entry for a case of goods, which, on being opened by the landing-waiter, was tound to contain a quantity of playing cards, not mentioned in the entry. The defence was that the defendant was not aware that the cards were in the case in question, and that being in doubt, he asked the advice of the Collector of Customs as to the manner in which the entry should be passed, but he declined to give him any information. The whole case hinged upon the meaning of a memorandum attached to the defendant's invoice, the latter reading it to mean that the cards were not sent. The Magistrate held that the case against the defendant was, proved, and fined him LIOO, which he subsequently reduced to L 25, the goods being forfeited, together with the other contents of the case, valued at L3O.
