Tuesday, November 4. ■ ■ Mr Matthew Price, Acting. Resident Magistrate and Warden during Mr. Re veil's absence, was engaged ,., in ; the; hearing of a number of civil, Tcases yester- ;- day, the case which occupied most time being that: of Burt and Co., Dunedin., y., Brockley, ;a dispute as tp a } quantity of iron delivered at Greymouth. t . The cvi-, dence taken was for the defence, and for transmission to Dunedin. Another case was that of the Grey Valley Tramway Company (in liquidation) v. J.D: Pinkerton, Ahaura— a claim of 'LSO contribution as the holder of 50 shares in the company. Mr Newton ior the plaintiff ; -Mr Guinness for.,the defendant. Mr Kenrict, the liquidator, stated the present liabilities of the company to be L3lO Bs. In May, 1871j in a case between the company and the defendant, i for payment of a call, a^ verdict had been entered for the plaintiff;' but on 'the 20th June, a re- Hearing was granted, and Jaly 4th the 1 case was withdrawn. — Mr James Wylde produced .a copy of the register of , shareholders, including the defendant's name, .for- 50 shares, an application, to r appear- by proxy at a general meeting on March; 2o, 1871, and a minute on? April; 11 accepting the defendant's^ resignation .as a director. The defendant had; not objected 1 to/h is name appearing on the register, arid had acknowledged himself 'a shareholder, but had refused to pay a call, .saying the company was not being carried on as he wished, and had- always "defended any action brought against him,. — .Mr Alexander' Montgomery remembered obtaining the signature of the defendant to the memorandum of association, and of attesting the signature afterwards. The. defendant signed voluntarily, first for : 25 shares, afterwards f0r. 50. He, believed he also signed the proxy in his presence. By Mr Guinness : The defendant, signed the memorandum of association previous to its being registered. .TheY proxy was signed after the memorandum of association. I think he was aware the company was registered ; there was a notice in the newspaper to that effect. The- words "fifty shares'' in the proxy are in my handwriting, written after the signature, for the guidance of the Secretary. I cannot say whether, at the time of filing the memorandum it bore my attestation. I cannot say whether I attested a week; after, nor when I signed it ; after the certificate of incorporation. lam not clear whether I attested it when I handed it in, or my second visit to Hokitika to get a certified copy. I think it was on the 1 second occasion.— Mr Newton having no further evidence to offer, the case was adjourned till November 11, for the procuring of evidence for the defence at Ahaura.
