DISTRICT COURT, AHAURA.
Friday, September 12. (Before His Honor Judge Harvey.) • iarceny. James Godfrey and Mary Godfrey were jointly indicted for that they did, on the 3rd July last, steal a quantity of wearing apparel and other articles, belonging to one Thomas Graham, of Ahaura. The prisoners pleaded not guilty. Mr South conducted the prosecution on behalf of the Crown, and Mr Staite and. Mr Guinness defended the prisoners. _ On| the application of the Crown Prosecutor,; it was decided to proceed with the charges against each prisoner separately. .The name of the female prisoner was therefore omitted from the indictment, and the, case proceeded. ■ ; The following witnesses were examined l — Thomas Graham, John Bees, Patrick Ryan, Jas. Davy, Sub-Inspector Goodall,. and Constable Meredith. For the defence, Robert Nelson was called. The jury, after some deliberation,; brought the prisoner in guilty as accessory! after the act, and he was remanded for sentence until the following day. • The female prisoner was then indicted,, and, the Crown Prosecutor declining to, offer any evidence, the jury, by his : Honor's direction, returned a verdict of acquittal, and she was discharged., The Court was then adjourned until Saturday.
