RESIDENT MAGISTRATE'S COURT, AHAURA.
(Before C. Whitefoord, Esq., R.M., and F. Guinness, Esq., J.P.) Friday, November 1. Dargan v. Dargan.— A summons for maintenance. There was no appearance of the defendant, and a warrant was ordered to issue for his arrest. Jane Watkins v.' Frank Rheberg.— A claim of L 9 153 6d, for board and lodging, &c. The defendant filed a set-off to nearly the amount of the plaintiff's claim, for work done as a carpenter. The particulars Qf the defendant's set-off were «one into first. Witnesses were called to prove that the prices charged by the defendant for his work were most exorbitant, and one item for ordering timb.er for the use of the plaintiff was disputed altogether. The defendant swore he went to Reid's sawmill; that he saw the proprietor there, and ordered the timber. This was denied, 1 and it was asserted that Rheberg had never been at the mill on the business pf the plaintiff.' A number of witnesses were examined, and the Bench,- after making deductions in several items of the defendant's set-off, allowed him L 5 17s 6d, including 10s, for ordering the timber at the sawmill. The verdict was for the plaintiff for L 3 183, the defendant to pay the costs of Court, with witnesses expenses. • M'Donald v. Mullina.— A claim of L 5 18s 6d, for butchers' meat. The defendant admitted his own liability, but repudiated his responsibility for his mates portion of the account. It appeared the goods were supplied to the defendant personally. Judgment for the plaintiff, with costs. Judgment for the plaintiff with costs was given in Hayes v. Kirwin, L 2 18s 6d. Police v. S. Horn was adjourned. ' The Court was adjourned to Nov. 8.
