A CORRECTION.

[TO THE EDITOR.] Sir — Permit me to correct an error in your report of the judgment given by His Honor Mr Justice Gresson in the Supreme Court, Nelson, on an application for a prohibition in the case of J. W. Day, now undergoing a sentence for larceny. Your report reads that — " The finding of the Resident Magistrate may or may not be such as I might have arrived at." And the correct report is — "The finding of the Resident Magistrate may not be such as I might have arrived at." As the erroneous insertion of the two words "or may" gives a meaning unfavorable to the prisoner,' while the correct report is in reality strongly in his favor — (and the distinction is obvious) and as, although the rule was refused on purely legal grounds, it appears from the judgment that had his Honor been adjudicating on. the case as a jury for the first time, the result might have been different, I consider that, in justice to my . client, prisoner though he is, a correct interpretation should be given to his Honor's judgment. lam, &c., Waj. S. Stajtb. Ahaura, Sept. 18. [The judgment, we believe, was printed according to the copy we received.]
