% Notwithstanding anything contained, in the Bth section of the said Act, upon the occurrence of the first vacancy in the members of the Waste Lands Board after th« passing of this Act, excepting a vacancy occurring in the office of Receiver of Land Revenue, the person who, on the occurrence of such vacancy, is Chief Surveyor of the Gourty of W stland, shall be {m} become a commissioner of and member^ 61 the said Waste Lands Board, so long as

he shall remain Chief Surveyor of the County of Westlandl and the person who may from time hereafter, be appointed Ohwf Surveyor shall, onfluch appointment, be and become a commissioner, and member of the said Waste Lands Board so long as he ahan^remaii^'wch Chief, Surveyor* , 3;-Tne 40th!, section in 1 the iaid*jAct M Hereby repealed, and^n lieu thereof it ia enacted that the remainder of "the pur--chase money, payable .by.any purchaser under the 39th sectionCof the said Act, shall be paid to^the Repeiverof Land Revenue tn full, at any aittingt of the Waste Lands Board, held within, thirty days after the day of sale; th^niat the neit sitting oHhe Board after tliftexpiration of such period of thirty dawand in default of payment at one dt the other of -such. sittings, the purchaser shall forfeit the deposit money, and alsotlalirigh.Wand title to th^Jand. , T^ 4. lings per acre ; (4) •'? at any time of continued residence of the lessee of any town, Sibiirban, or rural land he!d by him tnder lease heshp'l purchase the said land at -the upset price as f xed in the said Act, the rent- ' paid prior to the purch: *c of the said laud shall be taken into ac >unt i<* part payment of the piujhase money, and upon the balance be'ng paid to the Receiver of Land Revenue, the purchaser shall be entitled to a Crown grant thereof. Provided that if at any tf me<the hssee of any town, suburban, on jtV section shall neglect to pay, in advance, the annual rent, reserved in any lease thereby, for a period of three months after the same has become due, the Waste Lands Board shall have power to determine such lease, and to declare such lease foneited, and to dispose of the same by auction, inclusive of improvements effected theroon ; and after payment of the rent due and the expenses of the sale, the surplus shall be handed over to the lessee.

7. In lieu of the word " seventh" when the word occurs in the sub-section (8) of the said 78th section, there shall be inserted the word "fourth," and all land affected by the said sub-section and heretofore alienated, leased, or otherwise disposed of, shall be deemed to be and have been from the date of such alienation, lease, or disposition, subject in all reapects to the provisions of the sub-section, as effected as if the word "fourth" had been inserted in the said Act on the passing thereof.
