FRIDAY, JULY 19. '1',..";/- 1 (Before O. Whitefoord, Eaq*, RJW.) Rehberg v. Reid.— A claim of X9 ss, the alleged value of a kit of sawyer?* took and for detention. He left, and left his tools behind him, but afterwards requested the defendant to forward them to the Little Grey Junction for him. The defence was that the articles were forwarded as directed, but in crossing the Grey one cross-cut saw was lost. It was also shown that the. defendant paid 30s on the defendant's account, to his order. A verdict was given for the plaintiff for the value of the tools, less the value of the lost saw, and deducting the amount paid by the defendant on the plaintiff's account, the verdict to be reduced to Is oa^the restoration of the articles, ':■;' _ •■ Marshall v. He said he was summoned late on Tuesday, and on Wednesday and Thursday the roads were impassable, owing to the floods. Mr Staite for the plaintiff, strongly objected io_ the adjournment on such grounds. If ' adjournments were granted on these frivolous pretexts, it would be impossible to get both parties to a suit present in Court at the same time. The Magistrate said, under the special circumstance of the case' he would ,grant the adjournment, but , he did not wish it to be taken as a precedent. The case was then adjourned to Monday.
