RESIDENT MAGISTRATE'S COURT, AHAURA.
FRIDAY, JULY 19. '1',..";/- 1 (Before O. Whitefoord, Eaq*, RJW.) Rehberg v. Reid.— A claim of X9 ss, the alleged value of a kit of sawyer?* took and for detention. The plaintiff was working for the defendant, who is the proprietor of the Ahaura saw-mill. He left, and left his tools behind him, but afterwards requested the defendant to forward them to the Little Grey Junction for him. The defence was that the articles were forwarded as directed, but in crossing the Grey one cross-cut saw was lost. It was also shown that the. defendant paid 30s on the defendant's account, to his order. A verdict was given for the plaintiff for the value of the tools, less the value of the lost saw, and deducting the amount paid by the defendant on the plaintiff's account, the verdict to be reduced to Is oa^the restoration of the articles, ':■;' _ •■ Marshall v. Mann.— A claim of L2413s 3d, for goods supplied at Half-Ounce. The defendant admitted the debt, and, the plaintiff pressed for payment, as.the defendant had a good claim. The defendant explained that the share he was working was the property of Marr and Lock, and he (the defendant)' had a debt of L 23 to pay off before it became his property Judgment for the plaintiff with costs. David Kingham v. Peter Mulvey.PAn action for damages for breach of a contract about the purchase of a farm aud house near Ahaura. The plaintiff claimed LIOO. The defendant applied for an adjournment to enable him to procure legal assistance for his defence. He said he was summoned late on Tuesday, and on Wednesday and Thursday the roads were impassable, owing to the floods. Mr Staite for the plaintiff, strongly objected io_ the adjournment on such grounds. If ' adjournments were granted on these frivolous pretexts, it would be impossible to get both parties to a suit present in Court at the same time. The Magistrate said, under the special circumstance of the case' he would ,grant the adjournment, but , he did not wish it to be taken as a precedent. The case was then adjourned to Monday.
