At the Resident Magistrate's Court yesterday, after dismissing with a cautibh a, mancharged with drunkenness, the Magistrate heard » number of civil caseß. The only case involving any point of interest was the case of'Paterson v. the Paroa Road Board— a claim of L2G, being an alleged, debt of L 24 *odd, with interest added. Mr Perkins, who, - r r«^/ifnr the plaintiff, stated that two members of the Board wi stated that the claim would 'be admitted,- but he understood 'objection was now to be taken to the service of the summons, as it had been served on a member of the Board, instead of on the Chairman, or at the office. Ho tvas prepared however to prove service. "The Bailiff, finding the office closed/ went to a member 6f the Board and the Treasurer, and the^ acr cepted ' servipa. There was no provision made in the County of Westland Act as to the form of eerrice; The Secretary to th.c Board, who appeared on their behalf, contended that the service was insufficient, and referred to the 73rd section of $he Act. It was by the merest chance that the summons had that morning reached his hands. Mr Perkins held that the section quoted referred exclusively to contracts, and he stated that he held a letter from the Board/admitting the debt. The Magistrate ; found nothing in the Act as to service, but considered the service, as described by the Bailiff, to be perfectly good. The case was then admitted on the part of the defendants, and judgment was given by consent, /with L 2 9s as costs of Court, 10a for a witueas, and professional costs. — Craig and Co v. Do Costa— The defendant made an application for an adjournment for two mouths, which the Magistrate ' granted. —Dupre.,,v..
